This page offers electronic search on Judgments information. This information will help you understand the levels applied to this site. You will also find a help file to aid you using this service.

Selected Judgments 


This service includes all those judgments, which are indexed, i.e. the judgments that have a brief summary, as well as keywords attached to them. One should enter at least one criteria before starting to search. If one is going to search with a date range that is greater than two years, another criteria should be entered apart from the actual dates. The judgment date should be entered in a dd/mm/yyyy format. When choosing amongst the Court and Judiciary criteria, the site offers lists from where one can choose.


Keywords

If you are going to enter more than one keyword, separate them by means of a comma (,). Do not enter more than ten (10) keywords for every search. The site offers you two options from where to choose. If you choose the 'All Keywords' option, the system interprets all keywords together when searching (boolean AND). If you choose the 'Any Keyword' option, the system threats each keyword separately when searching (boolean OR). This implies that at least one of the keywords should be matched when retrieving judgments.

If for example, to look for "droga" or "multa", enter "droga,multa" and choose the 'Any Keyword' option. On the other hand, if you want to search for "importazzjoni" and "trademark", enter "importazzjoni,trademark" and choose 'All Keywords'.

The results of the Search depend on the criteria entered. The Clear button erases all the search criteria.

Judgments Archive 2001 onwards 

This archive includes all judgments given in 2001 onwards. The criteria that have to be entered for the search are exactly the same as those of the previous section. There are slight differences in how you request the Judgment Reference number. This reference number is split in three parts:

- the first part is the consecutive number of the case;
- the second part is the year when the case (to which the judgment is linked to) is registered at the Courts;
- the third is the sequence number.

It is advisable, that the Reference number is used as a search criterion if and only if, the person using the system knows this number beforehand.

The results of the Search depend on the criteria entered. The Clear button erases all the search criteria.

In this section, there are gathered all those judgments given in the last 12 months. The same search procedure can be applied like in the previous sections.

If this facility is chosen, you will find a list of judgments given in the last fifteen days. The same search procedure can be applied like in the previous sections.

Search by Keywords 

One can choose a letter from the alphabet to view all keywords starting with that letter. From the list one can choose a number of keywords to be able to search for particular judgements.

The keywords are split in two sections: those taken from the Legal Publishing Books and those taken from the judgements entered by the Courts of Justice (displayed in a different colour).

More than one keyword can be chosen, but in the case where keywords are chosen from both sections, the "All Keywords" option cannot be used.

List of Selected Judgments 

The results of the search are listed in judgment titles. This list shows the Judgment Date, Court and Parties. The magnifying lens symbol (Dettalji tas-sentenza) takes you to another page, which contains more details on the judgment.

The document symbol (Dokument tas-sentenza) links you to the document, which contains the full text of the judgment. The document is opened through an Acrobat PDF Reader. It will be opened in the same browser; otherwise first you need to save it. To see the just saved document, download and install the ACROBAT PDF Reader from here or from the ADOBE site.

If the document symbol is not visible, this means that the full text of the judgment is not linked to the judgment.

At the bottom of each page there may be links for other pages containing search results. If there are more than 10 pages containing results, an arrow is displayed which takes you to the next 10 pages of results.

List of Judgments Archive 2001 onwards 

The results of the search are listed in judgment titles. This list shows the Judgment Date, Reference Number, Courtand Parties. This symbol is visible only when the document is available, i.e. if the judgment is a selected judgments and if the document is attached to a judgment given during the last 12 months.

Otherwise, the envelope symbol (Ircievi s-sentenza b'Email) is visible on the page. This symbol indicates that the judgment full text document has been archived. If you press on this symbol, you can ask for the document electronically.

At the bottom of each page there may be links for other pages containing results of the search. If there are more than 10 pages containing results, an arrow is displayed which takes you to the next 10 pages of results.

Selected Judgments, in detail 

Choose the magnifying lens symbol (Detail) near the judgment title list to access this page. Here one can find further details on the judgment. The first part of the details include the book Volume Number, Part Number, Section, and Page in case where the judgment has been taken from the Legal Publishing Books. Otherwise, the Reference Number, the number which Courts assigns to the case to which the judgment is linked), will be displayed.

In the second part, the site displays the Judgment Date, Court, Judiciary, Parties, Judgement Type, Keywords, and Summary. Where the full text document is attached, this can be accessed in the same manner as explained in the List of Selected Judgments section.

At the bottom of this page one can choose from three links. The first one takes you back to the Search Page, the second one to the Results List and the third one displays the judgment information in a Printer friendly version.

Judgments Archive 2001 onwards, in detail 

From the list of resulting judgments, one can access this page by pressing on the magnifying lens symbol (Dettalji tas-sentenza). Here one can find further details on all judgments entered by the Courts of Justice personnel. Apart from the usual details on the judgment, one can find the Reference Number and the full text judgment document, when this is available. For more information on how to access and read the full text document, please refer to the List of Selected Judgments section.

At the bottom of this page one can choose from three links. The first one takes you back to the Search Page, the second one to the Results List and the third one displays the judgment information in a Printer friendly version.

Symbols used in Site 

Dettalji tas-sentenza The magnifying lens symbol allows you to view the full judgment details.

Dokument tas-sentenza When the full text judgment document is available, the document symbol can be used to access the document. Moreover, the judgment full text document is available only for the selected judgments and those judgments given in the last 12 months.

Ircievi s-sentenza b'Email This symbol is shown whenever the judgment full text document is archived. By pressing on this symbol, one can electronically ask for the judgment document given more than 12 months ago.

Printer Version 

The details are kept the same. Changes are made only in the format, so that the user has the possibility to print all the details in a printer friendly version. When printing, always choose the landscape format. To set this format go to File Menu and then Page Setup from the browser.

Validation 

Validation is made automatically on the search criteria entered by the user. If any errors occur, the user is notified with an appropriate and meaningful error message.

Printing 

One can also print the page by going to the File menu and choose Print from the MS Internet Explorer or Netscape browsers. In order to print properly, set the printer to print in a landscape format other than portrait.
